Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Conflate AI Pty Ltd (ABN: 27 690 700 684) ("Company", "we", "us", or "our"), concerning your access to and use of our application and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. The Service

AI Assistant Football Coach provides users with AI-powered analysis of football (soccer) videos. Users can manage player profiles, upload videos, and receive structured feedback and coaching recommendations. The availability of features may depend on your subscription plan.

3. User Accounts and Registration

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. Our Service is not intended for individuals under the age of 16. By using the Service, you represent that you are at least 16 years old or have obtained verifiable parental consent.

4. Subscriptions, Payments, and Credits

The Service is offered under various subscription plans ("Tiers") and may include the option to purchase one-time analysis credits ("Credit Packs").

  • Fees: You agree to pay all applicable fees for your chosen Tier and any purchased Credit Packs. All fees are non-refundable except as required by law.
  • Billing: Subscription fees are billed on a recurring basis (e.g., monthly or annually) as specified at the time of purchase. You authorize us to charge your chosen payment method for such fees.
  • Cancellations: You may cancel your subscription at any time through your account settings. The cancellation will take effect at the end of the current billing period, and you will not be charged for subsequent periods.
  • Usage Limits: Each Tier is subject to usage limits, such as the number of players you can manage or the number of analyses you can perform per period.

5. User-Generated Content

You retain all ownership rights to the videos and data you upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content solely for the purpose of operating, providing, and improving the Service. You represent and warrant that you have the necessary rights to grant us this license for any User Content you submit.

6. Acceptable Use Policy

You agree not to use the Service to upload, post, or otherwise transmit any content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Infringes any third party's intellectual property.
  • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

7. Intellectual Property Rights

Other than your User Content, the Service and its original content, features, and functionality are and will remain the exclusive property of Conflate AI Pty Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both Australia and foreign countries.

8. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We provide no warranties, express or implied, that the Service will be uninterrupted, error-free, or that the analysis provided will meet your specific requirements. The AI-generated feedback is for informational and coaching purposes only and should not be considered a substitute for professional in-person coaching or medical advice.

9. Limitation of Liability

To the fullest extent permitted by law, in no event will Conflate AI Pty Ltd, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. You may terminate your account at any time by ceasing to use the Service and/or deleting your account.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Victoria, Australia.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
